Coldplagiarism? Say It Ain't So, Joe!

Back in June, Coldplay were accused of plagiarism by Brooklyn indie-rockers Creaky Boards, who claimed that the title track to Coldplay's Viva La Vida album bore an uncanny similarity to one of their own songs--a song ironically titled "The Songs I Didn't Write." Creaky Boards even went so far as to allege--in a somewhat whiny, self-released viral video--that Coldplay frontman Chris Martin got the idea for "Viva La Vida" when he attended one of their shows at the 2007 CMJ Music Festival:

While there was admittedly some resemblance between the two tunes, nothing came of this. Coldplay went about their lives, racking up Grammy nominations and selling millions of records, and Creaky Boards simply creaked back into obscurity. But now a more prominent artist, guitar virtusoso Joe Satriani, is lobbying the same sort of charges at the Britrockers. Satriani has just filed a copyright-infringement lawsuit against Coldplay in Los Angeles federal court, and he may have a better case than Creaky Boards did.

Now, first of all, there's no denying the similarity--it's a lot stronger than the one between "Viva" and the Creaky Boards song (that mashup at the end of this video makes a particularly convincing point). The songs in fact sound so much alike, if we'd wandered into a Satriani concert and heard him noodling away during "If I Could Fly" onstage, we'd admittedly mistake it for a guitar-wanky "Viva La Vida" cover.

Of course, the similarity could be a coincidence--and therefore the sonic resemblance isn't enough for Satriani to collect the "any and all profits" he is seeking in a jury trial against Coldplay. Another crucial aspect of his case is whether or not Coldplay had the opportunity to steal the song.

In the case of Coldplay vs. Creaky Boards, it was kind of difficult to believe Chris Martin would randomly pop up at some unknown band's CMJ showcase (Chris publicly denied he attended the gig in question). So it was almost impossible for Creaky Boards to prove that Coldplay had had ample opportunity to hear (and subsequently plagiarize) "The Songs I Didn't Write." But the Satriani album on which "If I Could Fly" originally appeared, Is There Love In Space?, came out four years ago on Epic, a major label...so it is more feasible that the members of Coldplay did have some chance to be exposed to it.

Although, of course, it's also kind of hard to imagine that Chris Martin lounges around his London mansion with Gwyneth, Apple, and Moses, attentively listening to Joe Satriani jams with notepad in hand. But hey, you never know.

Anyway, whether or not Coldplay are guilty as charged, they certainly were aware of Satriani's accusation before the lawsuit was officially filed this week. Just wait for the 3:30 mark in the video below for Chris Martin's sly mention of a mystery man whose name rhymes with "Moe Batriani"...along with his impassioned insistence that "Viva La Vida"'s resemblance to any song, by any artist living or dead, is purely coincidental:

You know what's really odd about this whole situation. That YouTube video upped the key of Viva to match Satriani's instrumental. Yes, it has the same tempo. But Satriani goes off into his great guitar licks and Coldplay keeps singing and pumping the orchestra, which by the way is nothing like Satriani. Yes, his singing melody is similar to Satriani's in the beginning, but it's really nothing to consider plagiarism. I bet Satriani's legal counsel advised him to sue now to get the most publicity, because this came the day after Coldplay was nominated for several of the top Grammys. I'm a little humored by the idiocy of the people here who just leave comments like "no talent RIPP OFF artist" and such. If you don't like Coldplay, fine, but there's no reason to HATE them. Coldplay does not plagiarize. They are influenced by existing music. Satriani and Coldplay are a bunch of nice guys, and they'll work this out however.

That's an easy chord progression to get into trouble with - that progression is kind of in a pool in our collective unconscious as one of a few generic "international hit record" chord progressions (along with the 80's chestnut "You're My Everything", etc...) I believe that someone could put the same melody as Satriani & Coldplay to those changes independently, without hearing either. BUT - Satriani & Coldplay are in the same key....Now THAT I find suspicious....Yep,I think they heard Joe's record...

You can't compose music without inadvertantly ripping people off. The same goes with the written word or any other walk of life. I doubt whether Cold Play even has the musical taste to listen to someone such as Satriani. Just as the Rolling Stones gave credit and partial royalties to K.D. Lang, so should Cold Play do the same.

I am a big Coldplay fan. When the album was first released, I read an article how their big name producer(I forget his name at this point) made each band member bring in an album by different artists(Kanye West, etc( everyday to brainstorm ideas for a new sound for the album. What are the chances they brought in this album/song and, unfortunately, got more than just the idea? Probably pretty good.

Wow. That's quite a stretch. There are thousands of songs that sound very similar. The first song is a BIG stretch, and the second song does have the same (ish) riff, but yeah...not that close people. Who cares? People are just jealous about how amazing Coldplay really is.

I think Satriani is just mad because he has spent years noodling away at a guitar and no one really cares about his style or music.
It is probably a coincidence anyway, there are only eight chords in the entire world and it wouldn't be unusual for two bands to happen on the same chord construction.
I've been a fan of Oasis for years and they are always being accused of "ripping off" the Beatles however, if you look at the music before the Beatles and after they became popular you could accuse almost anyone of "ripping off" the Beatles.

Give me a break nothing U2 or Radiohead has done can even come close to matching songs like Clocks and the Scientist. Get a life and get your ears checked. These guys are as original as it gets. Every band has had influences even your beloved U2. Get some Q-tips. And lastly, Im sure Chris Martin needs to go around stealing songs so that he can finally break into the business...... Wake up idiots.

Sometimes as a songwriter you come up with a melody and think it is original,but where did it really come from. The phrasing of the two songs makes me believe that Coldplay had heard this melody and did not know where it came from. Still the two tunes are way too similar to not rule out a judgement in Mr. Satriani's favor

the first one - nope. not a rip off. inspiration perhaps. but not stolen.

satriani - nope. high unlikely. any serious composer knows how you can come up with a primary theme or melody, and at can be eerily close to another.

'nuff said.

I used to like Coldplay after Parachutes and definitley after a rush of blood to the head albums but the xy and Viva seem like something that was rushed to the store shelves to keep there name alive. It does sound too familiar to be coincidental but I also think that Chris Martin doing his little dance on stage with his little chicken legs is him trying to be Bono which he will never be cos he even agreed on the Ryan Seacrest radio show that U2 are the greatest rock band in the world I've seen U2 live about 20 times every tour since the Joshua Tree and I've seen Coldplay live once.... and once was enough.
