Jeff Hanson Management & Promotions, Inc., and concert promoter USA Interactive were also named as defendants.
The suit, filed April 20 in the Circuit Court of Cook County, Illinois, claimed that lead singer Scott Stapp "was so intoxicated and/or medicated that he was unable to sing the lyrics of a single Creed song." The four plaintiffs were seeking a refund of their $55.50 ticket price and their parking fees. In addition they were hoping that the suit would allow for the more than 15,000 fans in attendance to be added to the plaintiff list.
Circuit Court Judge Peter Flynn dismissed the suit "with prejudice," which essentially paves the way for the plaintiffs to file a new complaint if they should choose to do so.
