Judge Allows Refunds On 'Explicit' Evanescence Album

A Washington County Circuit Court judge has ruled that people who bought an Evanescence live album at Wal-Mart stores in Maryland can get refunds for it, according to Billboard.com. Last Wednesday's (August 10) ruling partially settles a lawsuit brought by a Maryland couple, who complained that the copy of the record they bought included explicit lyrics but did not carry a parental warning sticker. The album, called Anywhere But Home, was released in November of 2004.

Evanescence's label, Wind-Up Records, agreed to the refunds in exchange for having the claims against them dismissed. Anyone seeking a refund must show proof that they bought the album in a Maryland Wal-Mart outlet and that it was purchased before January 1, 2005.

The couple, Trevin and Melanie Skeens, is still suing Wal-Mart for allegedly deceiving customers by selling the disc without a warning sticker.
