Evanescence's label, Wind-Up Records, agreed to the refunds in exchange for having the claims against them dismissed. Anyone seeking a refund must show proof that they bought the album in a Maryland Wal-Mart outlet and that it was purchased before January 1, 2005.
The couple, Trevin and Melanie Skeens, is still suing Wal-Mart for allegedly deceiving customers by selling the disc without a warning sticker.
